At a Court held for Campbell County on Monday the 14th June 1797 at the House of Jacob Fowler in the Town of Newport.

Page 92-Ordered that John Montjoy, Alvin Montjoy, John Cook and James Lanead? or any two of them act as Commissioners to perpetuate testimony to establish an Entry of 40,000 Acres in the name of Daniel Coleman on the North side of Main Licking; also John Moseleys (Mosebys?) 1,000 Acres below the main fork of Licking about four Miles from the Forks & that they take the Depositions of such Witnesses as are brought (?) before them.

An Indenture of Bargain and Sale from Bartlet Bennet of the one part to John Hall of the other part was proved by the Oath of Cave Johnson one of the Witnesses thereto & ordered to be certified.

An account of the Partition of the Estate of William Cloud dec'd was returned & ordered to be recorded.

The last Will and Testament of John McCollum was proved by the Oaths of Samuel Vanhook and James McCollum Witnesses thereto sworn to by John McCollum & Bryant Senier the Executors therein named and Ordered to be recorded and Certified for obtain a probate thereof in due form was granted to the said Executors they having given Bond with James McCo1lum and Morgan Van Metre their Securities in the Penalty of L600 Current Money conditioned as the law directs the said Bond was acknowledged by the Executors & the Securities therein named.

Page 93-An Indenture of Bargain and Sale from Samuel Duval of the one part to David Mead and Charles Grymes of the other part was certified and ordered to be recorded.

An Indenture of Bargain and Sale from Neil Hughs of the one part to John McDonald of the other part was certified and Ordered to be recorded.

An Indenture of Bargain and Sale from Elias Langham for and in behalf of John McDonald & of himself of the one part to Robert Stubbs of the other part as certified & ordered to be recorded.

An Indenture of Bargain and sale from Neil Hughes of the one part to John McDonald of the other part was certified & ordered to be recorded.

An Indenture of Bargain and Sale from Presley Peek and Polly his Wife of the one part to William  Smith of the other part was acknowledged by the said Presley & Polly she having been first prively examined as the Law directs and Ordered to be recorded.

An Indenture of Bargain and Sale from John Hawkins of the one part to Presley Peek of the other part was acknowledged by the said John Hawkins and Ordered to be recorded.

Page 94-Ordered that John Hall, William Cave, &  John Bush or any two of them examine, state and settle the account of Jane Cloud Administratrix of William deceased and make report thereof to the next Court.

Ordered that John Mountjoy, John Cook,, John Roberts, Squire Grant, Charles Morgan and Cave Johnson act as Commissioners in and for the County of Campbell  to make division of any Lands held in conjunction by any persons making application to any two of them agreeable to an Act of Assembly entitled an Act "to appoint Commissioners for the division of Lands."

The Persons appointed to view & mark out the nearest and best way from Perrys ferry to the mouth of 3 Mile reported that they had viewed and marked out the same as follows beginning at a black walnut near Bellveals Sugar Camp on the Road from Perrys Ferry to Grassy Creek and running through the North East Corner of Charles Reynolds's Plantation crossing the Road from Newport to Grassy Creek at Kellys Sugar Camp passing by Charles Morgans Mill to the point on the lower side of 3 Mile run which Road we conceive will be very convenient & advantageous to the public & not inconvenient or disadvantageous to the Public.  On consideration whereof  it is ordered that the said Road be established as a Bridle Way agreeable to the Said Report that Charles Morgan act as Overseer of the Same & that the Male labouring Titheables along the Said Road and within one Mile thereof attend the Said Overseer in cutting out and Keeping the Same in good repair when called on.

The Persons appointed to view and mark out the nearest and best way from the Mouth of 3 Mile to intersect the George Town Road reported that they had marked the Same as follows beginning opposite the point on the lower Side of 3 Mile & running towards Lexington at about 480 yards from John Donovans House towards the Mouth of Licking which road we conceive will be very convenient to the Public & not inconvenient to Individuals. On consideration whereof it is ordered that the Said Road be established that Jonathan Ross act as Overseer thereof and that all the Male labouring Titheables below Bank Lick and one Mile below Said Road and opposite to the intersection on said Road attend the said Overseer when called on for the purpose of cutting out the Same & keeping it in good repair.

Page 96-An Indenture of Bargain and Sale from Henry Brasher and Lucy his wife of the one part to Elie Williams and Daniel Mayo of the other part was acknowledged by the said Henry & ordered to be recorded and a Commission awarded to take the privy examination of Lucy Brasher.

Ordered that a Certificate from John Roberts setting forth that by virtue of a Commission to him produced appointing Matthias Cauese ? a Justice of the peace from the County of Campbell (from his excellency the Governor of this Commonwealth) he duly qualified the Said Matthias as a Justice as aforesaid be recorded.

The Certificates of the due qualification of Thomas Lindsay and Obadiah Scott as Justices of the peace for this County are ordered to be recorded.

William Riddick who was qualified at April Court last as Sheriff of Campbell County came into Court and together with his Securities entered into & acknowledged Bonds according to Law - the Securities for the Bond in the penalty of 3000 Dollars were Squire Grant & David Lewis the Securities for the Bond of 1000 dollars were Henry Brazee? & Jacob Fowler.

Page 97-Morgan Van Metre is appointed Overseer of the Road from Bank Lick to the top of the big hill in the room of Thomas McCollum.

The Sheriff upon a certain Writ of ad quod darnnum to him directed on the Motion of William Daniel to ascertain whether he should be allowed to erect a Water Grist Mill upon Philips's Creek he owning the Lands on both sides of said Creek returned that he had executed it and therewith the Inquisition of the Jurors under their hands and Seals which being read and the prayer of the said William granted the said Inquisition was thereupon ordered to be recorded and is as follows We the Jury report that no Person can sustain any injury from the erection of the Water Grist upon Philips's Creek and that the navigation of the said Creek and the passage of fish therein will not be affected thereby.

On the Motion of Morgan Van Metre It is Ordered that a License be granted to him to Keep a Tavern in this County for one year he having with Henry Pickles his Security entered into and acknowledged their Bond conditioned as the Law directs.

Page 98-A Bond from John Bartle to John Grant was presented in Court proved by the Oath of Thomas Mosely and Ordered to be recorded.

Ordered that Bernard Stuarts Mark to wit a Slit in each Ear & an under Keal in the left Ear be recorded.

Ordered that Baylis Ashleys Mark to wit a Swallow fork in the left Ear and an under keal in the right be recorded.

Ordered that James Taylors Mark to wit a Crop and and under Keal in the left Ear and an under Keal in the right ear be recorded.

Ordered that John Williams's Mark to wit a Crop in each Ear and an under Keal in the left be recorded.

Ordered that Jane Clouds Mark to wit a Crop in the left Ear and Swallow fork in the right be recorded.

Ordered that Alexander McDonels Mark to wit a Crop on the left and a Slit in the right Ear be recorded.

Ordered that Charles Morgans Mark to wit a Crop Slit and under Keal in the left ear & Crop and Slit in the right Ear be recorded.

Page 99-Ordered that Presley Peaks Mark to wit a swallow fork in the left Ear and under Keal over Keal in the right be recorded.

Ordered that Cave Johnsons Mark to wit half a Crop in each Eear (sic) be recorded.

Samuel Vanhook is appointed Constable of this County he having taken the Oaths prescribed by Law & together with Obadiah Scott his Security entered into & acknowledged their Bond conditioned as the Law directs.

Ordered that John Tindall, Henry McGlohlin,  Arthur Connelly,  Achilles Killis ?Hillis & ___ Strange and William Tindall or any Two of them act as Commissioners to perpetuate testimony concerning the beginning of an Entry of 1000 Acres of Land made the 13th December 1782 about 10 Miles East of the Big bone Lick in the name of Benj Netherland and that they exercise such powers as are vested in them for the purpose aforesaid by the l0th Chapter of the Acts of 1794 & make return of their proceedings thereupon to the Court.

William German is appointed Constable of this County he having qualified according to Law & together with Henry Brasher his Security entered into & acknowledged their Bond conditioned as the Law directs.

Page 100-On the Motion of Thomas Rees It is ordered that a License be granted to him to keep a Tavern in this County for one year he having with William Riddick his Security entered into and acknowledged their Bond conditioned as the Law directs.

Ordered that Squire Grant and Obadiah Scott act as Commissioners to settle with Nathan Kelly Sheriff his accounts of the Levy of 1795 and make report thereof to the next Court.

On the Motion of James McClure It is ordered that a License be granted to him to Keep a Tavern for one year he having with William Riddick his Securety entered into and acknowledged their Bond conditioned as the law directs.

Whereas Charles Daniel Senr. is bound by a Bond as Security for James Taylor Clerk of this County for the faithful performance of the functions of his said office & he the said Charles praying that he may no longer be considered as Security as aforesaid thereupon the prayer of the said Charles is granted and Charles Morgan agrees to act as Security in his stead for the said James Taylor whereupon the same is Ordered to be recorded.

Page 101-Moses Scott is appointed one of the Commissioners of this County & to act in the whole Precinct above the Mouth of Licking or on the East side to the Forks thence up the South Fork to the County line instead of Joseph Robinson as far as it extends to this District - Certificates of the legal qualification of the Commissioners aforesaid were produced in Court & ordered to be recorded.

Ordered that Archibald Brown,  Jacob Barrickman and David Lewis act as Commissioners to lay out and prescribe the Marks where a Ditch shall run through the Town of Newport either through Streets Alley or Lots for the purpose of draining a Pond in said Town & that they superintend the letting of said Ditch but no expense is to be defrayed by the County.

Ordered that John Brasher be recommended to the Executive of this Commonwealth as a proper person to be appointed a Magistrate of this County.

On the motion of John Stuard ordered that his Costs a Writ of ad quod Damnum to be executed on the 10th July next be issued according to Law returnable to September Court to ascertain whether he ought to have leave to erect a Water Grist Mill on Fork Lick Creek where he owns the lands on both sides of said Creek.

Ordered that, Joseph Robinson,  Robert Kyle & David Lewis act as viewers to mark out, the nearest and best way from Henry Pickles to intersect the George road Town at the Bullock pen near Mr. Cummins's house and wake report to Court of the conveniences and inconveniences of said intended road  & ordered further that a Writ of ad quod damnum be awarded to be executed on the 17th Inst. to enquire the damages that William Cummins will sustain by the opening of said intended road & report thereon According to Law.

Ordered that Court be adjourned until Court in course at Wilmington to the house of John Grant.  Signed John Roberts
