Alfred Biery, administrator of Alfred Biery deceased, filed suit yesterday against the Chesapeake & Ohio Railroad Co to recover $1999. Alfred Biery was run down and killed by a train on the C&O Railroad in Dayton July 7 last.

Judge Yungblut in the case of Alfred Biery vs. the C&O Railway gave peremptory instructions to the jury to find for the defendant. Biery sued to recover $1999 for the killing of his son in Dayton, July 1907. The Court holds there was no negligence on the part of the railroad company.

Alfred Biery, 77, machinist of 8 21st St. Clifton, who was injured when caught between two autos at Fourth and Walnut streets Cincinnati, Friday night is recovering at Cincinnati General Hospital. Police said Biery was waiting for a street car when Walter Sweeny cranked his auto while it was in gear. Biery stepped back and was struck by another auto. He has skull fractures and internal injuries.
