John E Jackson, colored, has filed suit in the Campbell Circuit Court against Patrolman John Sheeran and the latter's surety to recover $1000 damages. Jackson, through Attorney E H Kilpatrick, alleges he was beaten by the defendant Sept 21 at Tuxedo Garden, during a ball given by the Hod Carriers Association.

Judge Berry of the Campbell Circuit Court will not trifle with cases with attorneys or litigants are dilatory in the trials. This morning the Court dismissed a damage suit because the plaintiffs were not present and their attorney did not know where they were.

The case in question was that of John Jackson against Edward Kearns, patrolman of the Newport force for $5000 damages. Jackson, who is colored, was in attendance at the hod carrier's ball at Tuxedo Garden about a year (ago) and claims that Kearns used unnecessary violence with his club during a fight at that place. He sued for the above amount.

Kearns alleged Jackson was one of the leaders of a small sized riot and he was compelled to use his club to subdue the participants in the fight. Judge Berry waited for some time giving the plaintiffs to appear. As the attorney could give no reason for their delay it was dismissed. Deputy Davis reported he had notified all parties interested.

The funeral of John Jackson, colored, shot and killed at his home Saturday afternoon in Newport, by James Crane, also colored, will take place this afternoon from his home.

Crane, charged with the killing, admits that he did the shooting, but pleads self-defense.
